Southland Fall Festivals – Terms & Conditions / Liability Waiver
By purchasing a ticket and/or entering Southland Fall Festivals, all guests acknowledge and agree to the following terms and conditions:
Assumption of Risk
Southland Fall Festivals is held on the grounds of a working nursery and outdoor event property. By entering the property, guests understand and acknowledge that they may encounter:
Uneven terrain
Dirt, gravel, mud, roots, grass, and natural outdoor surfaces
Wet or slippery conditions due to rain, irrigation systems, sprinklers, ponds, fertilizers, or other agricultural operations
Low lighting conditions
Temporary structures, cords, décor, props, inflatables, and event equipment
Loud noises, flashing lights, fog effects, actors, and Halloween-themed attractions
Guests voluntarily assume all risks associated with attending and participating in festival activities.
Release of Liability
By entering the event, guests agree to release, waive, and discharge Southland Fall Festivals, Southland Nursery, its owners, employees, contractors, volunteers, sponsors, and affiliates from any and all liability, claims, demands, damages, injuries, losses, or causes of action arising from or related to:
Slips, trips, falls, or other accidents
Personal injury or property damage
Participation in attractions or activities
Weather-related conditions
Interaction with animals, inflatables, props, actors, or event structures
Any other incidents occurring on festival grounds
Attendance and participation are entirely at the guest’s own risk.
Bounce Houses & Attractions
Guests understand that bounce houses, inflatables, slides, play areas, and other attractions involve inherent risks. Southland Fall Festivals is not responsible for injuries, accidents, damages, or losses resulting from the use or misuse of these attractions.
Parents and guardians are solely responsible for supervising minors at all times.
Photo, Video & Media Release
By entering Southland Fall Festivals, guests grant permission to Southland Fall Festivals, Southland Nursery, and affiliated brands to photograph, film, or record their image, voice, and likeness during the event.
Guests agree that these photos/videos may be used for:
Social media
Advertising and marketing
Websites
Promotional materials
Digital and print media
Guests waive any right to inspect or approve the finished materials and acknowledge that no compensation, royalties, or payment will be provided for the use of their name, image, voice, or likeness.
General Policies
Tickets are non-refundable unless otherwise stated.
Event operates rain or shine unless canceled by management.
Management reserves the right to refuse admission or remove guests for unsafe, disruptive, or inappropriate behavior without refund.
Guests must follow all posted rules and staff instructions while on the property.
By purchasing a ticket and/or entering Southland Fall Festivals, guests confirm they have read, understood, and agreed to these Terms & Conditions and Liability Waiver.
